These regulations define the rules for making purchases in the online store operated by the Seller at www.mapochopocho.com

§1 Definitions

1. Regulations – these regulations. In the scope of services provided electronically, the Regulations are the regulations referred to in art. 8 of the Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws of 2002, No. 144, item 1204, as amended).

 

2. Customer – a natural person, legal person or organizational unit without legal personality but with the capacity to perform legal acts, which places an Order in the Online Store under the terms and conditions specified in these regulations.

 

3. Consumer – a Customer who is a natural person who uses the Online Store for purposes not directly related to his or her business or professional activity.

 

4. Service Provider – an entity providing sales services via the Online Store under the terms and conditions set out in these Regulations.

 

5. Subject of the transaction – Goods listed and described on the website of the Online Store.

 

6. Goods – a movable item presented in the Online Store to which the Sales Agreement applies.

 

7. Sales Agreement – ​​a sales agreement for Goods within the meaning of the Civil Code Act, concluded between the Service Provider and the Customer, using the online service of the Store.

 

8. Online Store (Store) – online service available at www.ninjasushipolska.com, through which the Customer can place an Order.

 

9. Order – a declaration of will of the Customer clearly specifying the type and quantity of goods, aiming directly at concluding a Sales Agreement.

 

10. Teleinformatic system – a set of cooperating IT devices and software, ensuring processing and storage, as well as sending and receiving data via telecommunication networks using the end device appropriate for a given type of network.

 

11. Payment system operator - entity providing online payment acceptance services, FONDY LTD, 40 Gracechurch Street, London EC3V 0BT, England. Fondy Ltd

 

§2 General rules

1. These Regulations define the rules of using the online store available at www.mapochopocho.com.

 

2. The condition for placing an Order in the Online Store by the Customer is to read these Regulations and accept their provisions during the execution of the Order.

 

3. The Mapochopocho online store conducts retail sales via the Internet.

 

4. As part of the technical requirements necessary for cooperation with the IT system used by the Service Provider to execute orders, the Customer should have an active e-mail account and a device connected to the Internet that meets the following minimum technical requirements:

 

Internet Explorer browser version 10 or later.

minimum screen resolution 1024×768 pixels.

The Customer is obliged not to provide content prohibited by law, e.g. content promoting violence, defamatory or violating personal rights and other rights of third parties.

 

§3 Placing orders

1. All prices listed on the Ninja Sushi website are gross prices in Polish zloty. The prices do not include delivery costs, the minimum order value for free delivery is PLN 100.00.

 

2. Orders are accepted via the website.

 

3. Orders placed via the website can be placed from Sunday to Thursday and delivered on Saturday(opening hours may change on public holidays).

 

4. The order is effective if the Customer correctly completes the order form and provides correct contact details, including the exact address to which the order is to be sent and the telephone number and e-mail address.

 

5. If the data provided is not complete, the Seller will contact the Customer. If contact with the Customer is not possible, the Seller has the right to cancel the Order.

 

6. During the ordering process, the customer may express the wish to receive a fiscal receipt or VAT invoice, which may be attached to the order being shipped or sent by post to the indicated address.

 

7. When placing an Order, the Customer may consent to the placement of personal data in the Seller's Online Store database for the purpose of processing them in connection with the execution of the Order. In the event of consent, the Customer has the right to view their data, correct them and request their removal.

 

8. After the Customer places a successful order, he or she will receive an automatic response from the store confirming the order.

 

9. The start time of order fulfillment coincides with the moment of receipt of the payment to the bank account associated with the Przelewy 24 payment system in the case of payment by bank transfer or the moment of placing the order in the case of payment by card.

 

§4 Shipping costs

1. The order is sent to the address indicated in the order form. The Restaurant will immediately inform the Customer about an incorrectly completed order form, which prevents the shipment or may delay it.

 

2. The order is delivered by our company's courier on Saturday during working hours free of charge for orders over PLN 100.00

 

It is possible to collect your order in person at the address Targowa 33 or arrange own pickup.

 

§5 Payments

1. We issue a receipt or VAT invoice for every order sold.

 

2. Payment for the order can only be made via the electronic payment system FONDY LTD, 40 Gracechurch Street London EC3V 0BT England. when ordering via the website.

 

§6 Complaints procedure

1. Complaints regarding the operation of the website or application may be submitted by the user to the e-mail address: mapochopocho.com@gmail.com or in writing to the correspondence address Targowa 33, Warsaw 03-728 with the signature: Mapochopocho.

 

2. The complaint should include at least the user's e-mail address and a detailed description of the factual circumstances.

 

3. Complaints will be considered immediately, but no later than within 14 working days. The User will be informed of their complaint by e-mail or letter.

 

§7 The right of withdrawal from the contract by the customer

1. Before the Restaurant fulfills the service, the Customer may withdraw from the contract without giving any reason, and this right may be exercised until the Restaurant starts fulfilling the order.

 

2. In order to exercise the right to withdraw from the contract, the Customer undertakes to inform the Restaurant by means of an unequivocal statement by telephone contact with the Restaurant before Friday. After this time, the order cannot be canceled or changed, unless the Restaurant agrees to it. Informing the Restaurant about the desire to withdraw from the contract by e-mail is not sufficient for effective withdrawal from the contract.

 

3. If the Customer made the payment via the Internet, the funds will be returned by the Restaurant within 14 working days and 72 hours from the moment of receiving the refund order from the Restaurant.

 

§8 Final provisions

1. In matters not regulated by these Regulations, the provisions of the Act of 2 March 2000 on the protection of certain consumer rights and on liability for damage caused by a dangerous product (Journal of Laws 2000 No. 22 item 271, as amended), the Act of 27 July 2002 on specific conditions of consumer sale and amending the Civil Code (Journal of Laws 2002 No. 141 item 1176, as amended), the Act of 23 April 1964 - the Civil Code (Journal of Laws 1964 No. 16 item 93, as amended) shall apply.

 

2. Disputes arising from the application of these Regulations and in connection with the performance of contracts concluded between the Store and Customers will be considered by the competent court in accordance with the provisions on subject matter and local jurisdiction in accordance with the Act of 17 November 1964 - the Code of Civil Procedure (Journal of Laws No. 43 item 296, as amended).
